Bonus, Reward Programs and Boost Loyalty Program General Terms (the "General Terms")
1.General Overview
Mercuryo may from time to time in its sole discretion offer Clients virtual, digital, or non-monetary rewards, incentives, credits, or points (the "Bonuses") and operate promotional campaigns or loyalty programs (the "Reward Programs"), including the Boost loyalty program ("Boost"), in connection with the use of Mercuryo services.
Participation in any Reward Program, including Boost, is optional and requires the Client to accept these General Terms and any applicable program-specific terms (the "Program Terms").
In case of any conflict between these General Terms and the Program Terms, the Program Terms shall prevail.
The general terms governing the provision of Mercuryo services and the execution of crypto asset transactions are set out in the Terms of Service for Individuals accessible on Mercuryo’s website (the "Terms of Service").
All terms not expressly defined in these General Terms or the Program Terms shall have the meaning given to them in the Terms of Service.
All matters not expressly governed by these General Terms or the Program Terms shall be governed by the Terms of Service.
The Client acknowledges and agrees that Mercuryo does not organize lotteries, prize draws, or other activities requiring special permits under applicable law. Reward Programs do not require such permits.
2.Optional Nature of Reward Programs
Reward Programs and Bonuses are optional. They shall not be interpreted as rebates, guaranteed benefits, investment returns, yields, or financial advice.
Mercuryo determines, at its sole discretion, the structure, mechanics, and parameters of any Reward Program or Bonus, which may vary by Client, jurisdiction, type of service, or available payment method.
Availability, continuity, or future development of Reward Programs or Bonuses is not guaranteed.
3.Eligibility, Accrual, and Redemption
Bonuses are credited only after the Client satisfies all applicable eligibility criteria, which may include:
- Completion of a crypto asset transaction,
- Registration in the Mercuryo system,
- Identity verification,
- Participation in designated promotions.
Any cancelled or refunded crypto asset transaction shall not be considered valid for the purpose of awarding reward points under any Reward Program, including Boost. No points shall be credited for such a transaction. If points have already been credited for a cancelled or refunded transaction, Mercuryo reserves the right, at its sole discretion, to revoke, deduct, or adjust those points. Such adjustments may be reflected immediately in the Client’s profile in the Mercuryo system, and the Client shall have no claim against Mercuryo for any points revoked in accordance with this provision.
Bonus accrual may be provisional, delayed, conditional, or subject to verification.
Bonuses may only be used in accordance with the applicable Program Terms.
Bonuses, once credited, may be used in accordance with the options made available by Mercuryo from time to time. The available Bonus usage options are set out in the Client’s profile in the Mercuryo system.
Mercuryo reserves the right, at its sole discretion, to amend, modify, or withdraw any Bonus usage options at any time without prior notice.
Clients are encouraged to review their profile in the Mercuryo system on a regular basis to stay informed of any updates.
Should the Client have any questions, they may contact Mercuryo customer support via email support@mercuryo.io or use the chatbot available in their profile in the Mercuryo system.
Unless expressly allowed, Bonuses are:
- Personal,
- Non-transferable,
- Non-assignable,
- Non-sublicensable,
- Cannot be sold, exchanged, or combined with other promotions.
Any unused Bonus shall expire in accordance with its validity period, as defined in the Program Terms, without compensation.
4.Mercuryo Rights and Limitations
Mercuryo reserves the right to refuse, cancel, reverse, adjust, or revoke any Bonus or participation in a Reward Program where it reasonably determines that:
- The Client has breached the Terms of Service, the General Terms, or any Program Terms;
- The Bonus was obtained through error, misuse, fraud, manipulation, or prohibited conduct;
- Applicable laws or regulations have been violated;
- The Bonus resulted from a technical, pricing, or calculation error.
Bonuses are provided "as is" and "as available" without warranties of any kind.
Mercuryo shall not be liable for any loss, damage, delay, inability to use Bonuses, loss of benefits, technical malfunction, system error, suspension, or modification of any Bonus or Reward Program.
Mercuryo may impose limits on the number, frequency, or total value of Bonuses a Client may earn, hold, or redeem.
Mercuryo may suspend, modify, replace, or terminate any Bonus or Reward Program at any time without liability.
5.Personal Data
Mercuryo will process the Client’s Personal Data required to participate in any Reward Program in accordance with applicable data protection laws and its Privacy Policy accessible on the Mercuryo website.
6.Amendments
Mercuryo may amend the General Terms or any Program Terms at any time. Changes shall take effect upon publication on the Mercuryo website and in the Client’s profile in the Mercuryo system.
Boost Loyalty Program Terms
1.Participation and Activation
Boost is a loyalty program where Clients earn reward points (the "Boost Points") when purchasing crypto assets using eligible payment methods.
Participation is optional but requires activation by the Client. By activating Boost, the Client agrees to the General Terms and the applicable Program Terms.
2.Earning Boost Points
Boost Points are earned automatically when an eligible crypto asset transaction is completed using a supported payment method.
Information on the accrual of Boost Points, the number of Boost Points earned and credited upon completion of the transaction, and the available payment methods will be displayed to the Client during the checkout process in the Client’s profile in the Mercuryo system.
Where Boost is active on a transaction, the offer or quote shown to the Client (including any offer or quote made available through Mercuryo’s systems or through a partner’s interface) may present the total value of the transaction, comprising: (i) the crypto asset amount to be delivered to the Client’s wallet, and (ii) the indicative value of the Boost Points to be credited to the Client’s Boost balance.
The crypto asset amount actually delivered to the Client’s wallet as part of the transaction is displayed separately from the total value referred to above and reflects only the crypto asset amount settled on-chain in that transaction. Boost Points are not delivered on-chain as crypto as part of that same transaction; they are credited separately to the Client’s Boost balance, as described in Clause 3 below.
The Client may review the Boost Points history at any time in the Client’s profile in the Mercuryo system, in the “Loyalty Program” section.
3.Value, Accrual and Redemption
Nature of Boost Points
Boost Points are promotional in nature and do not constitute money, e-money, or any form of monetary value. Boost Points have no fixed monetary value and cannot be exchanged for fiat currency.
The accrual rates of Boost Points, as well as any indicative conversion or redemption values, are not fixed and are determined by Mercuryo at its sole discretion.
Mercuryo may, from time to time, display an indicative conversion rate (for example, a points-to-crypto or points-to-euro equivalent) for informational purposes only. Such indication does not constitute a guaranteed or fixed value of Boost Points and does not entitle the Client to receive that value in crypto or fiat currency other than through redemption in accordance with the Redemption Conditions.
Boost-Enabled Quotes and Total Value
When Boost is enabled on a transaction, the total value presented to the Client in the applicable offer or quote is not, by itself, the amount of crypto asset that will be delivered to the Client’s wallet. It reflects the combined value of (i) the crypto asset amount delivered to the Client’s wallet in that transaction, and (ii) the indicative value of the Boost Points earned on that transaction and credited to the Client’s Boost balance.
The Client acknowledges and agrees that:
- the crypto asset amount delivered to the Client’s wallet may be lower than the total value shown in a Boost-enabled offer or quote, because part of that total value is represented by Boost Points rather than by additional crypto delivered on-chain in the same transaction;
- this difference is an expected and intended feature of the Boost-enabled offer or quote, and does not, by itself, indicate a settlement error, a miscalculation, or a reduction in the value provided to the Client;
- Boost Points credited on a transaction are not paid out, transferred, or settled on-chain as crypto in that same transaction; they are held in the Client’s Boost balance and may later be used only in accordance with the Redemption Conditions and Clause “Redemption Process” below;
- any indicative value attributed to Boost Points for the purpose of displaying a total value is provided for informational purposes only, may change over time, and does not guarantee that the Client will be able to redeem the Boost Points for that same value.
Mercuryo, and where applicable its partners, may choose to display either the crypto asset amount delivered to the Client’s wallet only, or the total Boost-enabled value (including the indicative value of Boost Points), or both, depending on the interface through which the Client accesses Mercuryo services. Nothing in this Clause obliges Mercuryo or its partners to display both values in every interface, and the Client should refer to the specific figures shown in their profile in the Mercuryo system, and in particular to the amount confirmed at the time the crypto asset transaction is executed, to determine the exact crypto asset amount that will be delivered to their wallet.
Redemption Conditions
The accrual rates, conversion rates (if any), the number of Boost Points required for redemption, available redemption options, and any applicable thresholds (the "Redemption Conditions") are determined by Mercuryo at its sole discretion.
Redemption Conditions may vary depending on:
- the Client’s profile;
- services used;
- geographic location;
- or other factors determined by Mercuryo.
The applicable Redemption Conditions will be displayed in the Client’s profile in the Mercuryo system at the time the Client initiates a redemption request.
Redemption Conditions applied to a specific redemption do not create any expectation or right in respect of future redemptions. Mercuryo may amend the Redemption Conditions at any time at its sole discretion.
Where appropriate, Mercuryo may notify Clients of material changes to the Redemption Conditions. However, due to the dynamic nature of the Boost Points programme, such changes may be implemented without prior notice.
Redemption Process
Boost Points may be redeemed only through the Client’s profile in the Mercuryo system and solely in accordance with the Redemption Conditions available at the time of redemption.
Boost Points may be redeemed only for options made available by Mercuryo from time to time, including, for example:
- exchange for crypto assets (crypto cashout);
- discount on Mercuryo’s commission on a crypto asset transaction;
- access to other benefits;
- or other options as determined by Mercuryo.
Mercuryo reserves the right, at its sole discretion, to modify, limit, or discontinue any redemption option at any time.
Expiry of Boost Points
Boost Points are valid for 180 (one hundred eighty) days from the date they are credited to the Client.
Where a Client holds multiple batches of Boost Points, Boost Points credited earlier shall be redeemed first.
Any Boost Points not redeemed within the applicable period shall automatically expire without compensation and cannot be reinstated or exchanged for monetary value.
Information on the Client’s Boost Points balance and applicable expiration dates is available at all times in the Client’s profile in the Mercuryo system.
4.Restrictions
Boost Points are personal, non-transferable, non-assignable, non-sublicensable, and may not be sold, exchanged, or combined with other promotions.
Any credited and unused Boost Points shall expire without compensation upon the lapse of 180 (one hundred eighty) calendar days from the date of their crediting.
Boost Points are not legal tender and do not constitute money, deposits, or financial instruments.
Boost Points and any benefits associated with them are provided for promotional purposes only.
Boost Points:
- do not constitute investment advice, a recommendation, or personalised financial guidance;
- do not form part of any regulated financial service;
- do not influence or determine the execution of crypto-asset transactions.
Participation in the Boost Points program does not create any expectation of profit or financial return and should not be considered as an incentive to enter into any crypto-asset transaction.
5.Geographic and Transaction Limitations
Boost Points are earned only on eligible transactions and may not apply to all payment methods or jurisdictions.
Mercuryo reserves the right to limit the availability of Boost geographically.
6.Tiered Loyalty Levels
Mercuryo may introduce tiered loyalty levels offering additional benefits, including:
- spending Boost Points on transaction fees;
- extra value on purchases;
- exclusive perks for higher-activity users.
Exact tier rules and benefits will be announced in future updates and governed by additional Program Terms.
Mercuryo reserves the right, at its sole discretion, to amend, modify, or withdraw any tiered loyalty levels for Boost Points at any time without prior notice.
Clients are encouraged to review their profile in the Mercuryo system on a regular basis to stay informed of any updates.
7.Opt-Out
Clients may opt out of Boost at any time by disabling participation where such option is provided.
8.Program Term
The Boost program is valid for an indefinite period and may be modified or terminated by Mercuryo at any time.
Mercuryo will notify the Client of any termination of the Boost program by providing at least 1 (one) month prior notice via the Client’s profile in the Mercuryo system.
Mercuryo will notify the Client in a due manner of any amendments to the Program Terms via the Mercuryo website or the Client’s profile in the Mercuryo system.
