Legal Agreement MoneySwap OÜ

This User Agreement is an electronic agreement between you (the "User") and Mercuryo Systems (MoneySwap OÜ), a company registered and operating under the laws of Republic of Estonia, under the number 14461101, which is registered at Harju maakond, Tallinn, Lasnamäe linnaosa, Peterburi tee 47, 11415, license № FRK 000140, № FVR 000168, regarding your use of this website or application, all services, products and content provided by Mercuryo.

This agreement is addressed to persons (Users) who have reached the age of 18.

Customers (Users) are recommended to carefully read the terms of this user agreement.

Creating an account or using any Service is a confirmation that you have read, understand, and fully accept the terms of this current User Agreement and any potential subsequent changes and additions to it.

Completion of the following steps will constitute the user’s acceptance of this agreement:

After the user presses the "continue" button and advances to the notification of successful registration, the registration process is considered completed, and the terms of this user agreement become binding for the registered user.

The current version of the Agreement is posted on the official Mercuryo (MoneySwap OÜ) website at https://mercuryo.io/.

Mercuryo and a third party using the website located at https://mercuryo.io have entered into this User Agreement on these terms.

Access to the system, registration

In order to gain access to the System [1], the User needs to be registered, after which the User will be granted access to his/her User Account and Cyber ​​Wallet created on the basis of the account data.

To register in the System, the User must provide the following information:

The user must set a password when registering. The user can change the password at any time after the registration process is completed. The User is obliged to ensure the security and safety of his/her password and Account data from access by third parties. The User is responsible for maintaining the specified information and carrying out measures to prevent itfrom being compromised. If the password and/or account data are lost or compromiseded, and if third parties obtain illegal access to the User Account, the User is obliged to immediately notify Technical Support. To delete an account, the User must contact Mercuryo Support via email at support@mercuryo.io and specify the reason for the deletion of the account and personal data supplied during registration (name, surname, and phone number).

Refund policy

The service is irrevocable. If for any reason the service (crediting cryptocurrency to the User's cryptocurrency wallet) has not been rendered, the funds are returned to the client's bank card.

Responsibility

The client is responsible for complying with the requirements of current legislation, including legislation on combating proceeds from crime and the financing of terrorism; on cash and non-cash payments; on the protection of personal data; tax legislation; banking legislation; and currency legislation.

Each Customer shall be solely responsible for complying with the requirements of Mercuryo and the requirements of the law, for any operations performed by him/her in connection with the implementation of operations in Mercuryo through or with the assistance of Mercuryo, other data processing systems, or telecommunications facilities.

The Client bears the responsibility for taking the necessary measures to ensure the security of operations carried out by the Client, including acting in accordance with the internal service terms, regulations, and other documents related to information security recognized by the service.

The client guarantees that he/she possesses all the necessary knowledge to use Mercuryo’s services.

The client guarantees that his/her activity on the Internet does not contradict the generally recognized principles and norms of morality.

The parties are exempted from liability for non-fulfillment of mutual obligations in the event that their failure to act was a consequence of force majeure circumstances arising after their acceptance of this Agreement, or the occurrence of extraordinary events that could not be prevented or anticipated before they accepted this Agreement. The party in respect to whom the circumstances of force majeure apply, must notify the other party no later than 10 days after the occurrence of these circumstances.

In cases not provided for in this Agreement, non-fulfillment or improper execution by the Parties of their obligations under it shall entail liability in accordance with legislation.

In the event of disputes and emergency situations or events that cause operational disruptions, including in the case of suspected compromise of the key, the Client shall immediately inform Mercuryo about these situations and events as well as their causes and consequences in any way available to the Client.

Further actions of the Parties shall be determined individually for each request by agreement of the Parties, and may be regulated in whole or in part by corresponding treaties or separate internal documents of the Parties.

All disputes and disagreements relevant to this Agreement that arise in the process of using the Mercuryo service shall be resolved through negotiations.

The basis for the commencement of negotiations is the submission by one Party of a written claim to the other Party.

The claim shall be considered within thirty days from the moment of its receipt, after which the Party that received the claim shall satisfy the claim of the other Party or send it a reasoned refusal in writing.

In the event that a dispute cannot be resolved through the claim procedure within 60 days, either Party may apply to acourt at the service location. The Mercuryo system is not liable for risks related to the company itself, including force majeure circumstances resulting in a complete or partial loss of security of the customer's account, for example, in case of fire or other restrictions on access to funds providing a confirmed stock of digital currency (bankruptcy of banks, payment systems, or other cases associated with full or partial restriction of access to the provision of the digital currency).

[1] The "System" is a set of software and hardware used by Mercuryo in automatic mode to process operations performed by the User in his/her User Account.
